• Generated Outputs: The resulting synthetic videos, audio files, storyboards, and scripts generated by the Service.

C. Usage & Technical Data

• Log Data: IP address, browser type, operating system, pages viewed, time spent, and referring URLs.
• Cookies and Tracking: Cookies, local storage, and similar technologies to maintain session state, track performance, and remember your preferences.

2. How We Use Your Information

We process your data for the following purposes:

• Providing the Service: To render dual-mode videos, synthesize speech, compile storyboards, and run natural language editing interfaces.
• Data Isolation: Embedding and storing your organization's Knowledge Base files using isolated, organization-scoped vector database indexes.
• Service Optimization: Managing and scaling computing resources, APIs, and rendering engines.
• Communication: Sending system updates, security alerts, and billing notifications.
• Security & Compliance: Preventing unauthorized access, fraud, deepfake policy violations, and misuse of the platform.

AI Model Training Policy

• Starter, Professional, and Business Plans: For users on these standard plans, we may use your uploaded scripts, text prompts, and generated Outputs to train, fine-tune, and improve our proprietary AI models and generation algorithms. If you do not wish to have your data used for training, you may request an opt-out by contacting us at [email protected], or upgrade to our Enterprise plan.
• Enterprise Plan: We explicitly guarantee that no uploaded assets, Knowledge Base documents, scripts, voice data, prompts, or generated Outputs from Enterprise workspaces will be used to train, retrain, or improve our proprietary AI models or third-party foundational models.

3. Sharing & Disclosure of Information

We do not sell your personal data or user content. We share data only with trusted service providers (subprocessors) necessary to run the Service:

• Hosting & Cloud Infrastructure: Amazon Web Services (AWS) / S3 and Railway for secure storage and web hosting.
• AI & Text Processing: OpenRouter (for script/prompt reasoning).
• Voice & Audio Synthesis: ElevenLabs and fal.ai (for generating natural, expressive synthetic speech and voice-over files).
• Visual Generation: fal.ai (for rendering images, visual templates, and background assets).
• Authentication & Identity: Clerk for secure user registration, multi-factor authentication, and active session management.
• Payments: Stripe or other billing providers for subscription payments.

All subprocessors are bound by strict data processing agreements ensuring your data is protected and not utilized for their own training purposes.

4. Data Security & Storage

• Encryption: All data is encrypted in transit using TLS 1.3 and at rest using AES-256 encryption.
• Isolation: Customer data is logically segregated. Organization-scoped knowledge base documents and vector embeddings are shielded by Row-Level Security (RLS) policies.
• Retention: We retain personal data and user content for as long as your account remains active. You can delete your uploaded assets or generated videos at any time through the dashboard, which will trigger deletion from our active storage.

5. International Data Transfers

As GAINS AI LABS PRIVATE LIMITED is based in India and uses cloud providers hosted globally, your information may be transferred to, stored, and processed in the United States and other countries. We utilize standard safeguards and contractual provisions to ensure equivalent protection under applicable international privacy laws.
